أولًا: متى يعد الخصم غير قانوني؟
يُعتبر الخصم غير مشروع إذا توفّر أحد الشروط التالية:

| عدم وجود تحقيق رسمي في المخالفة | ✅ |
| عدم إبلاغ العامل بالمخالفة | ✅ |
| تجاوز الخصم الحد المسموح شهريًا | ✅ |
| الخصم على بدل السكن أو النقل دون مبرر | ✅ |
| الخصم بسبب شكوى العامل أو مطالبته بحقوقه | ✅ تعسف |
| الخصم لأسباب تتعلق بالحمل أو المرض | ✅ ممنوع |
📌 تذكّر:
نظام العمل السعودي يحمي الراتب بنفس قوة حماية حياة العامل المهنية.
ثانيًا: الحد الأعلى للخصم شهريًا
وفق نظام العمل:
لا يجوز أن تتجاوز الخصومات 50% من أجر العامل الشهري
أي خصم أعلى من ذلك: ❌ غير قانوني
ويثبت للعامل حق التعويض وليس الاسترجاع فقط.
ثالثًا: إثبات الخصم غير المشروع — ما الذي تحتاجه؟
قبل أن تتحرك قانونيًا… اجمع أكبر قدر من الأدلة 👇
✅ مسير الرواتب قبل وبعد الخصم
✅ رسائل بريد/واتساب/نظام HR
✅ صورة لأي إنذار أو عقوبة
✅ شهادات شهود من زملاء العمل
✅ إثبات أن الأداء جيد سابقًا
✅ كشوف حضور وانصراف
📌 في المحاكم:
القرائن لها قوة كبيرة جدًا — وليست المستندات فقط
رابعًا: ما الذي يحق لك المطالبة به بعد الخصم؟
إذا ثبت أن الخصم غير قانوني… فالأمر أكبر من مجرد استرداد المبلغ المخصوم!
يحق للعامل:

سادسًا: الفرق بين الخصم التأديبي والخصم التعسفي (فصل مُقنّع)
بعض أصحاب العمل لا يفصلون العامل مباشرة… بل يستخدمون الخصم كسلاح ضغط حتى يترك العامل العمل من تلقاء نفسه 😔
وهذا يُسمّى:
فصل تعسفي مُقنّع
الفرق بين النوعين:

📌 إذا ثبت أن الخصم كان بهدف دفعك للاستقالة:
→ فأنت ضحية فصل تعسفي وتستحق تعويضًا كبيرًا وفق المادة 77 ✅
سابعًا: أمثلة حسابية على التعويض بعد خصومات تعسفية
مثال 1: خصم 30% شهريًا دون مبرر
الراتب: 6000 ريال
الخصم لمدة: 6 أشهر
المبلغ المخصوم:
6000 × 0.30 × 6 = 10,800 ريال
📌 يحق للعامل:
✅ استرداد 10,800 ريال
✅ تعويض إضافي عن التعسف (يحدده القاضي)
مثال 2: خصم بدل النقل دون توفير نقل

بدل النقل 500 ريال
-
تم خصمه 12 شهرًا
الحساب:
500 × 12 = 6000 ريال مستحقة
مثال 3: خصم بسبب إصابة عمل
📌 التعويض يكون أكبر لأنه ضمن الحماية
ثامنًا: خطوات المطالبة بحقوق العامل رسميًا — خطوة بخطوة

اطلب مستندًا يشير للائحة الجزاءات

عاشرًا: حقوق العامل الوافد في حال الخصم
✅ المطالبة بكامل حقوق العامل المالية
✅ عدم تقييد نقل الكفالة عند التعسف
✅ حق التظلم دون تهديد بالإلغاء الوظيفي

📌 قاعدة ذهبية:
لا تتنازل عن راتبك دون مراجعة قانونية
ثاني عشر: هل يحق لك التعويض عندما يكون الخصم فصلًا مقنّعًا؟
نعم ✅
وفق المادة 77 من نظام العمل
إذا ثبت أن الخصم قصد به:

إجبار العامل على الاستقالة

أو دفعه لترك المنشأة تدريجيًا
📌 يعتبر ذلك فصلًا تعسفيًا مُقنّعًا
مثال مبسط:
الراتب: 7000 ريال
سنوات الخدمة: 6 سنوات
التعويض وفق المادة 77:
7000 × 2 × 6 = 84,000 ريال
بالإضافة إلى:

المكافأة

بدل الإجازات
-
رواتب مستحقة سابقة
ثالث عشر: حساب التعويض عن الخصم غير القانوني
القاعدة القانونية:
التعويض = الضرر المالي + الضرر الأدبي (عند إثباته)
أي:
✅ استرداد كامل الخصومات السابقة
✅ تعويض إضافي عند التعسف
رابع عشر: الأسئلة الشائعة (FAQ)
ما المدة القصوى لتقديم الشكوى؟
يفضل تقديمها خلال 12 شهرًا من تاريخ الخصم.
هل يحق لصاحب العمل خصم أيام العطل الرسمية؟
